Bill would let developers build without HOAs

The Arizona Senate passed HB 2518, which will prevent counties and cities from requiring home builders to establish planned communities governed by HOAs. The establishment of a home owners’ association would no longer be a condition of getting permit, but the bill would not prevent a developer from establishing a planned community with an HOA board.

The bills’ sponsor, Senator Gail Griffin said the issue is a matter of choice. Griffin says that since the advent of home owners’ associations, many people are forced into developments with HOAs or must buy older homes outside of planned communities.

The Arizona Legislature is frequently called on to get involved in issues arising from individual home owners being “bullied” by the powerful HOAs. The powerful HOA lobbyists are well funded, and individual home owners stand little chance against the hordes of lawyers them employ.

The bill now moves to the House where it is expected to easily pass.
