Nogales man who assaulted Border Patrol agents sentenced

Daniel Alberto Silva, 40, of Nogales, Arizona, was sentenced to 40 months in federal prison followed by three years of supervised release on January 28, 2014. Silva pled guilty on Nov. 19, 2013, to two counts of assault on a federal officer.

On August 18, 2013, in Nogales, Arizona, two U.S. Border Patrol Agents were trying to arrest Silva in connection with an alien smuggling investigation. Silva fled on foot and as he was running, he pointed a firearm at the two agents, who were in their patrol vehicle chasing him. Once Silva was apprehended, agents found a .32 caliber handgun in the area where they had seen Silva point the weapon at them. Agents also found three rounds of .32 caliber ammunition in Silva’s pocket.

The investigation in this case was conducted by the United States Border Patrol agency.
