At some point the 35 year old female was able to break free and flee the apartment. She made her way through the complex knocking on doors in an attempt to get help. A 40 year old male neighbor opened his door and came to the aid of the female. Martinez, who was pursuing the female, confronted and attacked the neighbor.
The assault spilled into the neighbor’s apartment. The neighbor, in fear for his life and the safety of the female, produced a hand gun and shot the suspect striking him the chest. The suspect then turned and fled the apartment. He collapsed about 150 yards into the complex as Scottsdale Police Officers were arriving. He was treated and transported by Scottsdale Fire personnel to Scottsdale Health Care Osborn.
Martinez remained in the hospital until he was medially released on December 22, 2014. He was taken into custody by Scottsdale Violent Crimes detectives. He was held on charges of Kidnapping, Sexual assault, Aggravated Assault and Burglary.
The 40 year old neighbor faces no criminal charges in the event and has asked that his name be withheld. The female victim is doing well.
