DPS Receives Grant from Governor for Seat Safety Belt Campaign

The Department of Public Safety (DPS) has received a grant totaling $40,000 from the Governor’s Office Office of Highway Safety (GOHS) that will enhance DPS’ passenger protection education and enforcement program targeting motorist seat belt and child restraint usage.“The ultimate goal is to get more drivers and passengers in motor vehicles to wear their seat belts,” said Lt. Col. James McGuffin of DPS’ Highway Patrol division. “Seat belt usage can dramatically reduce the severity of injuries and possibility of death when a collision occurs.”

DPS will utilize the funding to enhance the seat belt program throughout 2015 by conducting saturation patrols, added manpower and participation in local and national campaigns such as “Buckle up Arizona, It’s the Law” and “Click it or Ticket.”

In 2014, DPS issued 17,673 citations for restraint-device violations. Of those, 2,680 were for child safety seat violations. DPS officers make approximately 475,000 traffic stops each year.

Penalties vary by local jurisdiction fine schedule. For example Tucson ranges from $179.00 to $87.00 with a provision that in the case of a child restraint violation the entire penalth can be waived if evidence is presented that the proper equipment is installed. there is generally a fee to enroll in a two hour class.

D. A person who violates this section is subject to a civil penalty of fifty dollars, except that a civil penalty shall not be imposed if the person makes a sufficient showing that the motor vehicle has been subsequently equipped with a child restraint system that meets the standards adopted pursuant to subsection C of this section. A sufficient showing may include a receipt mailed to the appropriate court officer that evidences purchase or acquisition of a child restraint system. The court imposing and collecting the civil penalty shall deposit, pursuant to sections 35-146 and 35-147, the monies, exclusive of any surcharges imposed pursuant to sections 12-116.01 and 12-116.02, in the child restraint fund.

DPS issued 14,993 non-child restraint citations in 2014, which could have garnered as much as $2,600,000 in fines for local jurisdictions.
