Tucson Excavating Company Has Licenses Revoked

On Tues., May 19, 2015, Arizona Registrar of Contractors (AZ ROC) signed a Consent Order settling eleven cases filed against B & M Excavating and Hauling, Inc. (B & M) and revoking their three contracting licenses, effective June 1, 2015.

From late-2013 to Jan. 2015, AZ ROC received ten complaints against B & M for issues related to work they were contracted to perform stemming back to late-2012 and as recently as July 2014. The complaints were received from residential property owners from Hereford, Sierra Vista, Amado, Marana, and Tucson, Arizona, and totaled $1,073,963.62 in contractual agreements.

AZ ROC investigated each complaint and filed eight separate citations for 47 alleged issues ranging from abandonment of projects and poor work to contracting beyond the scope of their license and contracting with an individual suspended or revoked on their license.

On Tuesday, AZ ROC made official the seven page consent order; dismissing 17 counts and revoking B & M’s three licenses for 30 admitted violations of Title 32, Chapter 10 of the Arizona Revised Statutes.

Three complaints remain outstanding and will continue to proceed through the adjudicative process regardless of B & M’s agreeing to have their three contracting licenses revoked through this consent order.
