As reported in the Arizona Daily Independent on September 9, 2013, Margarita Gomez (formerly Margarita Gomez Leon) was indicted on April 10, 2013 for various charges relating to preparing false tax returns from March 21, 2007 until April 8, 2010 through her tax return preparation service, M & M Tax Service, in Tucson where she resided.
During the first week of September, she pleaded guilty in federal court.
She prepared returns to obtain fraudulent refunds exceeding $200,000 through the preparation and filing of federal individual tax returns, which contained false refund claims.
To promote this scheme, she solicited clients, who did not have legal status to work or reside in the United States. Gomez prepared and submitted false Forms W-7 to the IRS to obtain an Individual Taxpayer Identification Number, which falsely identified individuals as being dependents of the respective taxpayers, obtained and manufactured bogus documentation including letters from area schools, which purported to corroborate attendance for the dependents claimed on the false federal individual income tax returns. She then established mail drops under her control to facilitate the collection of refunds as well as having funds direct deposited to accounts she controlled. Among other violations, she purposely did not sign as the preparer of the return.
The Arizona Daily Independent reported her sentence could range from 0 to 51 months plus Restitution to the IRS for the amount of tax losses ($208,000) at the time of her sentencing. Her sentencing date was originally set for November 14, 2013. On Feb. 3, 2014, Margarita Gomez, 32, of Tucson, was sentenced by U.S. District Judge John A. Jarvey to 30 months imprisonment. Gomez pleaded guilty to corruptly endeavoring to obstruct and impede the due administration of the Internal Revenue Laws. Gomez was also ordered to pay $200,408 in restitution to the Internal Revenue Service (IRS).
