On December 6th, 2015 at approximately 3:35 am a gray 2004 Dodge Ram ½ ton pick-up truck, driven by Tracy Lynn Scott, was traveling southbound on Cave Creek Road when he struck Oscar Rene De Le Pena, age 30, who was walking in the roadway on Cave Creek Road at Paseo Dulce/Skyline Road.
Tracy Scott, age 49, was on his way to work and stated he did not see the person in the road until it was too late. Oscar De Le Pena was wearing dark clothing at the time of the collision and was walking in the travel portion of the roadway (not in a crosswalk).
De Le Pena was transported to Honor Health John C. Lincoln Hospital with life threatening injuries. On Monday December 7, 2015, Oscar De Le Pena was pronounced deceased and transported to the Maricopa County Medical Examiner’s Office.
Scott was not injured in the collision. He was evaluated by a Drug Recognition Expert and found not to be impaired by drugs and/or alcohol.
